These GTC apply to all contracts between FU.Signature Living GmbH, Heidestraße 19/19A, 10557 Berlin, and third parties (guest) concerning the rental of apartments for accommodation in the property at Kurfürstendamm 69, 10707 Berlin.
2.1 By submitting a reservation request, the guest makes an offer to conclude an accommodation contract. If the booked apartment is available, the guest will receive a binding reservation confirmation from FU.Signature Living GmbH, thereby concluding an accommodation contract between FU.Signature Living GmbH and the guest.
2.2 The contracting parties are FU.Signature Living GmbH and the guest. If a third party has booked for a guest, they shall be jointly and severally liable to FU.Signature Living GmbH together with the customer. These General Terms and Conditions then apply to both the guest and the ordering third party.
2.3 The guest's general terms and conditions only apply if expressly agreed in advance.
3.1 The apartment is provided to the guest for accommodation purposes.
3.2 The guest must treat the apartment, including its furnishings, with care. The guest must also show appropriate consideration for the legitimate interests of other guests.
3.3 Use of the apartments for purposes other than accommodation, in particular for permanent residence, is not permitted.
3.4 Organising and holding events or parties in the apartments is not permitted. In the event of a violation, FU.Signature Living GmbH will charge an additional cleaning fee of €500 as lump-sum compensation for damages. The guest may provide proof that no damage or less damage has occurred. FU.Signature Living GmbH reserves the right to prove and claim further damages.
3.5 Smoking is not permitted in the apartments. In the event of a violation, FU.Signature Living GmbH will charge a cleaning fee of €250 as lump-sum compensation for damages. The guest may provide proof that no damage or less damage has occurred. FU.Signature Living GmbH reserves the right to prove and claim further damages.
3.6 Pets are not allowed in the apartments unless the guest proves a legitimate interest in individual cases and FU.Signature Living GmbH agrees in writing to the keeping of the animal in the apartment. In the event of a violation, FU.Signature Living GmbH will charge a cleaning fee of €500 as lump-sum compensation for damages. The guest may provide proof that no damage or less damage has occurred. FU.Signature Living GmbH reserves the right to prove and claim further damages.
3.7 FU.Signature Living GmbH is entitled to provide services through third parties.
The guest is not entitled to sublet the booked apartment. They are also not entitled to assign to third parties the right to use the apartment arising from the accommodation contract.
5.1 The guest is obliged to pay in full and on time the agreed rent for the booked stay as well as any additional services used. Unless otherwise agreed, payment is to be made in advance.
5.2 The prices stated on the respective booking platform or in the offer from FU.Signature Living GmbH apply. These include the statutory taxes and charges in force at the time of contract conclusion. They do not include municipal charges payable by the guest (e.g. City Tax / Berlin bed tax) where these are required by law.
5.3 FU.Signature Living GmbH is entitled to request a reasonable advance payment or security deposit at the time of contract conclusion or thereafter, for example in the form of a credit card guarantee or authorisation.
5.4 Unless another payment term is agreed, invoices must be paid immediately upon receipt without deduction. In the event of late payment, statutory provisions apply.
5.5 The guest may only offset claims against undisputed or legally established counterclaims.
6.1 The guest may withdraw from the accommodation contract at any time. The withdrawal is effective upon receipt by FU.Signature Living GmbH.
6.2 The cancellation conditions stated in the booking confirmation apply.
6.3 If the guest does not arrive (no-show), the full agreed rent is due, unless another arrangement has been made.
7.1 The apartment is available to the guest from the agreed time on the day of arrival.
7.2 On the day of departure, the apartment must be vacated by the agreed time.
7.3 Handover of the apartment and keys takes place according to the procedures specified in the booking process.
8.1 FU.Signature Living GmbH is liable for damages resulting from intentional or grossly negligent breaches of duty.
8.2 For slightly negligent breaches of duty, FU.Signature Living GmbH is only liable if an essential contractual obligation (cardinal obligation) is breached.
8.3 Liability under the Product Liability Act remains unaffected.
8.4 FU.Signature Living GmbH is not liable for valuables, cash, or other items stored by the guest in the apartment.
FU.Signature Living GmbH collects, processes, and uses personal data of the guest solely for the performance of the accommodation contract and to fulfill legal obligations. Further information on data protection can be found in the privacy policy on the website.
10.1 Amendments and additions to the accommodation contract must be in writing. This also applies to the waiver of the written form requirement.
10.2 Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected.
10.3 Contracts between FU.Signature Living GmbH and the guest are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
10.4 The place of jurisdiction for all disputes arising from the accommodation contract is Berlin, provided the guest is a merchant, a legal entity under public law, or a special fund under public law.
11.1 The guest undertakes to comply with the house rules. These form part of the accommodation contract.
11.2 Violations of the house rules entitle FU.Signature Living GmbH to terminate the accommodation contract without notice.
12.1 The apartment is cleaned before the guest's arrival and handed over in proper condition.
12.2 The guest undertakes to treat the apartment with care and to keep it clean during the stay.
12.3 FU.Signature Living GmbH reserves the right to carry out cleaning or maintenance work during the stay if necessary.
13.1 If the apartment key is lost, the guest must bear the costs of replacing the lock or duplicating the key.
13.2 If the guest damages the apartment or its inventory, they must compensate FU.Signature Living GmbH for the resulting damage.
